MYERLEE CIRCLE BOARD UPDATE

Several months ago, the Board of Directors started discussing the need for major repairs and painting of the front of our condominiums.

Although the fronts of our condos appear to be brick, it is a colored stucco that has never been painted/sealed since the units were built, to protect and prevent

ongoing deterioration. Over the past three (3) years, the association has had to pay increased costs to repair damaged window sills, and multiple cracks of the

stucco on many of our buildings. Consequently, the board investigated the appropriate options to help prevent further deterioration.

Sherwin Williams specialist reviewed the condition of our buildings, offered information about the best products to use as part of the painting process and

supplied the Unit Director names of paint companies, some who also are able to do sealant of the stucco. Upon review of the cost for painting versus sealant,

painting was the most cost effective option which the board approved in

February, 2024.

Preparation for painting will include trimming,  cutting or removing some bushes that are blocking the painter’s ability to get close enough to repair the stucco, remove the outdoor plastic shutters then power wash the units before major

repairs can take place.

OWNER’S CONCERNS:

  1. The board is contemplating painting the front of the units a different color which will remove the look of a brick front. According to the paint specialist

hired to paint the units, if a sealant is used instead of paint, the stucco would have a shiny appearance and would not cover the flaws of the stucco, such as dark or faded spots from the sun and the shutters.

  1. The board has stated they are unsure if the shutters can be put back on after painting is completed, the paint needs to cure. They may need to wait several months before a decision can be made. Consequently the shutters that survive removal will be stored in the association’s shed, per the Unit Manager.

  1. Owners raised concerns and dissatisfaction that they do not have the right to vote on the paint color and

replacement of shutters.

Before considering this Paint and Repair Project, the Board did obtain clarification from our legal council on the Board’s role and responsibility for the necessary

maintenance of the association’s real property. They indicate that the board does not require a vote from the membership to change paint color or permanently remove the shutters.

Several Petitions addressing owners concerns regarding painting the units a different color, removing the look of brick, and, possibly, not having shutters –

replaced after painting is completed were circulated throughout the community.

The Petitions were sent to the Board with a request to include the paint project on the March Agenda, which occurred.

There was a lively discussion about this project during the March meeting, but no decision about paint color or shutters was reached. Although there was a request

for a Members Meeting to take place in early April, the Board of Directors felt that they must obtain advice from their legal council before going forward with the project.

The April Members Meeting is delayed till further notice. Potential project start date is June 2024 because of this controversy.
