Medical Emergency/Pandemic Plan

 EMERGENCY DECLARATION: The Board of Directors of Myerlee Circle Condominium Association, in an effort to protect the unit owners and continue to operate the Association as a sound business, is developing a plan to operate during a medical emergency/pandemic.  The following is a plan to continue to have a strong Association and to protect the privacy, health & safety of our Unit Owners/Residents.

 COMMUNICATIONThe main source of communication during this time will be email and word of mouth for those who do not have email.  All unit owners should be helpful to get information out to their neighbors in case emails are not available.  If you do not have an email address or if you have a change to your email address, please contact the Board.  Owners/Residents should use emails to communicate their questions and/or concerns to the Board through the Boards e-mail, in order to allow the Board members to address their issues.

 If you have a medical emergency call 911.

If there is a maintenance emergency, email the Board at board@myerleecircle.com or the web site at myerleecircle.com and enter your message under “Contact Us.”  The designated Board Member will respond to your concerns.  If you do not have a computer, contact the Association at

If the Association is without power for some reason, the Board will assign a member to post information on the outside Board at the Club House on a daily basis if necessary.  It will be the responsibility of the Unit Owners to check it for updated information.  Unit Owners/Residents can also drop a note through the slot of the office door of the Club House if there is a problem or questions.  The Office will be checked on a regular basis to retrieve that information and pass it on to the designated Board Member.

It is important that the Association maintain as much interaction with the Unit Owners/Residents as possible to take care of their needs.  It is not a time to go dark.

AMENITIES: The Association has the right to declare certain portions of the common areas off limits due to health and safety issues.  The Board of Directors will vote on the closing and reopening of the amenities to include, but not limited to, the pool, club house, bocce ball, the gardens, etc., after advisement from Federal, State and Local Governments.

 PROTOCOL FOR NOTIFICATION OF INFECTED OWNERS

When the Association learns of a potential positive test, the Association should attempt to confirm with the Owner/Resident, and if that person will agree to disclose their name you can also do so, so that other Owners/Residents can determine if they came in contact with that person.  Otherwise, simply advising the community that there is a positive test is appropriate.

After the Unit Owner/Resident has notified the Association of the positive test, it is the responsibility of the Board of Directors to:

Advise the Attorney that there is a case in our complex without divulging the name and location of the Unit Owner/Resident if that is their request.

  1. Notify all Unit Owners/Residents that there is an active case in the community as stated above.
  2. If an infected Unit Owner/Resident becomes difficult to deal with, and doesn’t quarantine, the Board is required to contact the Health Department who in turn notifies Law Enforcement. Also, at the same time we are to notify our attorney so they can send a demand letter.

This same process will be in place if someone comes into our complex from another highly effected area and does not quarantine for 14 days as required by the Governor.

Failure of the Unit Owner/Resident or Guests to adhere to the laws during this time is a crime and will carry a $500 fine and up to 60 days jail time enforced by local law enforcement.

ASSOCIATION FINANCES:  Maintenance Fees, late fees and any outstanding Assessments will continue to be collected in accordance with the Myerlee Circle Condominium documents.

It is important that the Board take inventory of the expenditures during this period and delay purchasing or contracting for anything to be done until the medical emergency/pandemic is over.

If the Association cannot pay the necessary bills, due to lack of Revenue caused by a medical emergency or pandemic, the Board will hold a special meeting to address the issues.  Reserves can be used; however the Unit Owners would have to vote on re-appropriating the existing reserves and designate the new use of those funds.

 REGULATIONS The guidelines for this plan are to be in compliance with Federal, State and Local Governments as well as the Bylaws, Rules and Regulations of Myerlee Circle Condominium Association.

 COMMUNITY ACCESSCommunity Access, before “Stay at Home” order, will be defined by the local government.  Guests coming into our community must abide by the requirements of the area they are coming from.  If coming from the epicenter of the virus or a high risk area, they should quarantine themselves for 14 days.  Depending on the situation, the Association could take legal action and/or contact the health department and/or law enforcement.

A “Stay at Home” order would mean you should not have any guests other than required Health Care Workers        or Contractor’s for emergency repairs.   Guests will not be allowed, including Realtors selling units or people looking to rent units however, Realtors are not prevented from selling units on line.

Only Essential workers should be allowed on the premises.    Essential workers will be defined as:

1.  Maintenance Employee – Only addressing outside needs

  1.   Lawn Maintenance if they do not need to use facilities
  2. Repair Contractor’s for the purpose of addressing a unit emergency repair
  1.   Health Care Professionals when required
  2.   Deliveries are permitted

There can be different requirements issued by the Government entities at different times.  This plan is subject to changes as mandated by those governing entities.

 BOARD MEETINGS:  Board meeting will take place as defined in the condominium documents with the exception of congregational meetings.

When unable to meet traditionally, we will use technical support, as best as possible to conduct business as close to normal as possible.  We will use our line of communication to get the meeting times and plans for including the owners.
