MYERLEE CIRCLE CONDOMINIUM ASSOCIATION BOARD
MINUTES
6945 DOG LEG WAY
FORT MYERS, FL. 33919. DATE : 8/20/20
Meeting called to order by President Wynberg at 10:30 A.M. All board
members in attendance.
MAINTENANCE REPORT:
Mike reports the Main Circuit Board was down, repair person contacted.
President Wynberg requests entire system to be checked.
Mike identified some downspouts that have been hit by the landscaping
crew. Incidents reported to Landscape Supervisor. who states he will take
care of the problem and speak to his crew. Angel will bring in Sod to
repair area of lawn, owner identified water leak in front corner of her
gutter. Area will be reviewed.
SECRETARY’S REPORT:
July Board Minutes reviewed and accepted as read.
Secretary presented Summary of an ESA Webinar delivered by Becker &
Poliakoff legal team. Important Points discussed by legal team, include:
1) Healthcare Provider must have personal knowledge
2) There is no certificate for an ESA
3) Letter from Healthcare Provider must identify what the animal does
for the owner/ including if need the animal when at work.
4) Healthcare Provider does not need to be a Florida Healthcare
Provider
5) ESA can be a miniature horse and/or other type animals
6) Animal can accompany owner to the pool it cannot go into the pool,
nor can the animal be present where food is being prepared
7) Boards can not deny approval for an ESA accommodation based on
breed and/ or size
8) Do not have to update need for ESA on an annual basis EVEN if it is
declared temporary.
9) Board cannot deny ESA request if owner does not complete the
Association forms
10) If animal is aggressive or a nuisance after initial approval, Board
can request additional accommodation requirements-this should
be discussed with your legal council
11) When or if an owner indicates they have a Foster Animal due to the
Pandemic, must have a letter supporting a YES decision for
temporary need-must discuss with legal council before decision
12) Legal Council recommends review of ESA policies and Procedures
on a yearly basis, but do not try to Amend Docs yearly
13) DO NOT PUT ESA REQUEST AND OTHER PAPERWORK IN OWNER’S
FILE
14) OWNER HAS THE RIGHT TO PUT IN A COMPLAINT TO HUD WHEN
DENIED, IF JUDGEMENT IS DECIDED AGAINST THE ASSOCIATION,
THEY MUST PAY THE FINE.
Annual Meeting Questionnaire sent by our Legal Council to be completed
beforethe March, 2021 Meeting. Pearl reports that as of July 1, 2020,
section 760.29(4) of Florida Statutes was amended to delete the
requirement that “housing for older persons communities…55 and over
communities-register with the Florida Commission on Human Relations.
Previous law required registration to be updated every two(2) years.
TREASURER’S REPORT:
review of July financials, accepted as read
Linda states pending condo sale for late September, 2020
Linda reminded Board Members to submit budget requests for 2021 as
soon as possible. Budget Committee will start meeting in late September.
VICE PRESIDENT’S REPORT:
Final version of Contractor’s Policies reviewed and accepted.
Unit Director will be responsible for follow-up and collection of
appropriate paperwork. Discussion took place on best way to notify
owners of this new requirement. No vote taken at this time but possibility
of sending information and forms in a notice form to owners. More
discussion required at September Board Meeting.
Joyce was informed by our insurance agent to expect premiums to go up
anywhere from 10-40%.
PRESIDENT REPORT:
President Wynberg spoke with Myerlee Garden’s Board Members
regarding Bunker Way safety concerns. Appear issue is in process of
being resolved.
DIRECTOR’S REPORTS
POOL/CLUBHOUSE REPORT: Pool requires a new Solar Wheel which will
be ordered. Kim reports no additional pool violations this month.
UNIT DIRECTOR:
Dave presented revised Parking Regulations. Request for clarification for
size of boats and other recreation vehicles that can park at the
maintenance shed. Dave will have Mike stripe parking lot for parking
spots. Dave will rewrite the Parking Regulations then have Julia email to
owners. 4 Driveways on MCCB will have their driveways repaired in late
August due to their unsafe conditions. Dave suggest the association
consider budgeting each year for 4 driveways to be repaired due to
safety concerns. All board members agreed. Dave identified continued
issues with owners not breaking up their cardboard before putting in the
recycle bin, request approval to fine an owner $100.00 for this violation. All
board members agreed. Dave will ask Julia to email owners about this
policy.
GROUNDS: Sandy Opened discussion about tree planting policy , shade
tree vs Palm tree. President Wynberg identified how this decision should
be made(location of tree to owner’s condo). No vote taken on this policy at
this time. Sandy indicates unable to do fertilization at this time due to low
budget
Sandy reports that some owners have volunteered to assist with planting
for the Memorial Garden, Angel to do the prep work for the garden and
possibly assist with planting. $300.00 already approved for the Memorial
Garden. Sandy also reports that owner(Tom) is aware he is responsible to
replace tree he had removed. Will return in November, 2020.
NEW BUSINESS: BoArd member request change in time for meetings due
to her work schedule. All members agree, Monthly Board Meetings will
take place on the third Thursday of each month @ 1:30PM. Owners will be
notified of change.
